  1. Scope of Application of the Terms of Sale

    The present General Terms of Sale apply to the sale of products offered on (from hereon referred to as the “Website”) property of the company Powergee Italia S.r.l. (from hereon referred to as PowerGee), with Registered Office in Via Sistina 121, 00187 Rome, Italy and registered since 22/01/2004 with the Company Registry of The Rome Chamber of Commerce under n° 07788571003, VAT and Fiscal Code N° 07788571003 and R.E.A. n° 1055656.

  2. Purchasing

    The Website is an ecommerce website for Private Individuals and Resellers. Prior to any purchasing, Customers are required to create an account by filling in the registration form available. Upon acceptance of registration, Customers will receive a confirmation email within 24 hours from application specifying username and password necessary for login to the Website, reseller price viewing and purchasing.

  3. Prices and Invoicing

    Prices are displayed in Euros. Payment and invoicing shall be exclusively in Euros. Customers with a valid Italian VAT number will receive a VAT invoice.
    Customers resident in any of the other European Union Member States with a valid European Union VAT number will be invoiced without VAT.
    In order to assist our international Customers in their purchases, prices may be viewed, as well as in Euros, in any of the other European and major international currencies by use of the currency converter available on the Website’s homepage. This function is made available for purely informative reasons and does not provide any guarantee of a specific exchange rate as all orders, payments and invoices will be managed exclusively in Euros.
    Customers from outside the European Union are not eligible to purchase directly from the Website but are welcome to contact PowerGee through the appropriate contact form available in order to agree on the most appropriate alternative method of ordering available to them.
    For all orders received via the Website, PowerGee will issue an invoice for all products shipped. In case of multiple shipments for a single order multiple invoices will be issued.
    Invoices will be sent electronically (email) but may also be included inside one of the cartons shipped to the Customer.

  4. Products

    Products displayed on the Website come with a product description with their main characteristics detailed and with images in an effort to describe the product as accurately as possible. Product colours may however differ from reality due to variable viewing conditions that may vary from a computer user to another.
    Additionally, in an effort to improve its products, PowerGee may vary the graphics of its packaging and during the transition phase from old to new models may supply its products in mixed blister versions within the same order until stocks of the superseded product have run out.
    Alkaline, Lithium Coin and Lithium Photo batteries have a 5 year shelf life from date of production. The expiry date of Alkaline and Lithium Photo batteries is printed on the individual battery labels in a mm-yyyy format (e.g. 01-2018), whilst Lithium Coin batteries have their expiry dates printed on the back side of the blister.


  5. Delivery Costs and Delivery Mode

    1. Shipments in Italy


      Private Consumers: delivery charges to Italian Private Consumers will vary from a minimum amount of €2,00 VAT included to a maximum amount of €8,00 VAT included depending on the weight of the shipment and will be calculated automatically during the ordering processes and added to the cart.

      Resellers: delivery charges to Italian Resellers will be FREE OF CHARGE for a minimum order value of €120,00 + VAT. For order values below this amount, a delivery and administration fee of €12,00 + VAT will be charged to the invoice.


    2. Shipments outside Italy
      Delivery costs to Customers outside Italy will be calculated proportionally to the quantity of goods ordered and recharged in the invoice.
      Delivery costs will be calculated during the order process and added to the cart.
      Minimum order value: orders less than €60 excluding transport will not be accepted.

    3. Delivery Mode
      Orders will be shipped by means of a PowerGee appointed courier with transit times varying between 1 and 3 working days in Italy and between 3 and 7 working days for other European Union destinations from date of shipment.
      Transit times are to be considered as additional to PowerGee’s standard shipment preparation times (1 to 2 working days).
      At time of delivery, Customers are required to check for any missing goods, any non-conformity compared to the order issued, the state of the cartons received and any visible damage to the same or to the inner boxes or contents within. Any photographs are welcome and can be emailed to PowerGee as evidence.
      In the event of the above occurring, Customers are advised to sign the delivery note provided by the courier as receipt noting “Goods Received Unchecked” detailing clearly on the same the conditions observed. Should Customers fail to do so PowerGee may not subsequently accept the complaint.
      In addition and in the event of the above, Customers are required to notify PowerGee in writing by fax or registered post within 8 days from the date of delivery.

  6. Payment Method
    The following payment methods are acceptedi:

    1. Cash on Delivery (Italy and Resellers Only)
      Upon receipt of the goods, Customers shall pay the appointed courier in cash or by bank cheque or draft in favour of PowerGee Italia S.r.l..
      However, cash on delivery is not possible for amounts exceeding €1000 according to Italian Law (N°201 art. 12 comma 1, dated 06/12/2011).
    2. Online Credit Card Payment with PayPal
      By selecting the PayPal payment option, Customers will be directed to PayPal’s login page. By selecting the option “Non hai un conto PayPal?” (You don’t have a Paypal account?), Customers may pay with PayPal’s online credit card service, using major cards such as Visa, Mastercard, American Express.
      As the payment is managed directly by PayPal, Customers do not share their credit card details with PowerGee who does not save any such data in its archives.
      In addition, PayPal protects transactions thanks to its effective fraud prevention systems by controlling every single transaction in order to prevent any fraudulent activity from occurring and to guarantee a highly secure payment system.
      For payments using PayPal’s online credit card service, Customers will receive a confirmation email directly from PayPal confirming the transaction.

    3. Payment using a PayPal Account
      By selecting the PayPal payment option, Customers will be directed to PayPal’s login page where they can login to their pre-existing account with PayPal using their user and password access codes and subsequently authorise the payment.
      As the transaction is managed directly by PayPal, Customers do not share their financial details with PowerGee who does not save any such data in its archives.
      For payments using a PayPal account, Customers will receive a confirmation email directly from PayPal confirming the transaction.

    4. Bank Transfer in Advance (Resellers only)
      By selecting payment by bank transfer, Customers commit to paying by bank transfer within 8 days from the date of acceptance of the order.
      During this period, PowerGee commits to freezing the prices confirmed in the order and reserves the right to wait for credit of the payment on the bank account before proceeding with the shipment. It is not therefore sufficient to send PowerGee a copy of the bank transfer.
      PowerGee is not responsible for bank transfer times that can vary on average between 2 to 5 working days from the date of payment and as a function of the banks involved. In case of non receipt of the bank transfer after 14 calendar days from the date of the order, PowerGee will consider the order as automatically cancelled.

      Bank details will be informed to the Customer at time of order confirmation.
      Customers are kindly requested to write the order number and date in the bank transfer.

  7. Product Availability
    During the order process, availability of single items is shown in the initial product description by means of a coloured bar.
    Green indicates product is in stock; yellow indicates product has limited availability; red indicates product is temporarily out of stock.
    In case of red (product out of stock), customers are advised to contact PowerGee to check when product will newly become available.
    In exceptional cases and for technical reasons, it is possible that the product shown as available may be subsequently out of stock after confirming the order. In case of such a rare event, Customers will be contacted by PowerGee and will be given the option to modify the order before shipment for the part of the order relative to the product out of stock.
    In cases where customers have already made the payment for the product subsequently out of stock and where customers cannot wait for the product to become newly available, PowerGee will rapidly refund the amount paid for the product in question.

  8. Complaints and Returns
    PowerGee will not accept returned goods from Customers if not previously authorised. Any complaints regarding the conditions of goods delivered, missing product or the non-correspondence with the order, should be notified in writing to PowerGee by fax or registered post within 8 days from the date of delivery of the goods concerned.
    PowerGee will provide the Customer with a return material authorisation reference number (RMA) and will collect the product subject of the complaint directly or by means of a partner courier with all costs borne by PowerGee. Goods should be returned by the Customer in packaging suitable for transportation.
    Following receipt and inspection of the authorised returned goods, PowerGee will rapidly refund the Customer for the amount relative to the goods subject of the complaint.

  9. Warranty
    All products supplied by PowerGeeare covered by manufacturer warranty, 18months for Resellers and 24 months for Private Individuals.
    In case of product defect, informed by the Customer in writing to PowerGee within 18 months (Resellers) and 24 months (Private Individuals) from date of delivery respectively, the Customer may request product repair (where possible) or product replacement free of charge with the same or equivalent product. In case the above is not possible, the Customer will be refunded.
    However, any damage or malfunctioning as a result of accidental occurrences not directly attributable to PowerGee or attributable to the Customer or to an inappropriate use of the product and/or not conforming to the requirements stated in the technical documentation included with the product, are excluded from the warranty cover. Additionally, any indirect damage to other products used with the product purchased from PowerGee is also excluded from PowerGee’s responsibility.

  10. Information on Privacy and Data Protection
    PowerGee Italia S.r.l., with Registered Office in Via Sistina 121 – 00187 Rome (RM), Italy is responsible for the treatment of personal data provided by customers.
    All Customer personal data released to PowerGee during the contractual relationship will be collected and treated manually and by means of information technology for reasons strictly related to the establishment and management of the commercial relationship with the Customer, according to the requirements of the Italian Privacy and Data Protection Act, Legislative Decree n. 196, 30th June 2003 and subsequent amendments.
    Powergee is however authorised to supply customer personal data to external organisations for purposes strictly connected to the execution of the contractual obligations towards the Customer such as, for example, PowerGee’s courier partners, information technology partners in charge of the Website’s maintenance, banks for the consultation of payments by the Customer to PowerGee as foreseen by the contract.

  11. Disputes and Jurisdiction
    In the event of any dispute relating to a purchase from the Website and where not possible to settle by mutual agreement, the court of Rome, Italy shall have exclusive jurisdiction over the dispute according to Italian Law.
